Before you publish: this document has been drafted specifically for GAMYO's product and Indian operating context, but it is not legal advice and we are not your lawyers. Have a qualified Indian advocate review it — particularly the ride-sharing, liability and payments sections — Company particulars (CIN, GSTIN, registered office, grievance officer) are live and correct.
1. Agreement to these terms
These Terms & Conditions ("Terms") form a legally binding agreement between you ("you", "User") and , a company incorporated under the Companies Act, 2013 with CIN and registered office at ("GAMYO", "we", "us").
By creating an account, downloading the app, or using any part of the GAMYO platform, you confirm that you have read, understood and accept these Terms and our Privacy Policy and User Guidelines, which are incorporated here by reference. If you do not agree, do not use GAMYO.
These Terms are published in accordance with Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and constitute an electronic record under the Information Technology Act, 2000. They do not require a physical or digital signature.
2. Definitions
- Platform — the GAMYO mobile applications (Android and iOS), the website at gamyo.app, and all associated features and services.
- Travel Plan — a journey a User shares on the Platform (origin, destination, date, time and mode of travel) so that other Users may ask to travel alongside them.
- Connection — the mutual agreement formed when one User requests to join a Travel Plan and the other User accepts.
- Traveller — any User of the Platform, whether they are driving, riding, or travelling by any other means.
- Safety Information — any alert, warning, route suggestion, place recommendation or other travel-risk output the Platform provides.
- Content — any post, story, reel, live broadcast, comment, message, image, video, review, profile information or other material a User uploads, transmits or displays.
- Modules — the six functional areas of the Platform: Feed, Travel, Explore, Chat, Profile and SOS.
3. Who may use GAMYO
- You must be at least 18 years old and legally competent to contract under the Indian Contract Act, 1872.
- You must not be barred from using the Platform under any applicable law, and must not have been previously removed from GAMYO for a violation of these Terms.
- If you drive on a journey arranged through the Platform, you must hold a valid driving licence for that vehicle class, either own the vehicle or have the owner's express permission to use it, and the vehicle must carry valid registration, insurance and (where applicable) a valid pollution-under-control certificate.
- One person, one account. Accounts may not be shared, sold or transferred.
4. Your account
You are responsible for the accuracy of the information on your profile and for everything that happens under your account. Keep your login credentials confidential and tell us immediately at if you suspect unauthorised access.
You may set your profile to Private, in which case only approved followers can see your posts and profile. You may delete your account at any time from the app; deletion is handled as described in the Privacy Policy.
5. What GAMYO is — and is not
Read this section carefully. It defines the limits of our role and is the basis on which the rest of these Terms operate.
GAMYO is a travel safety ecosystem: a technology platform that surfaces travel risk, helps Travellers connect with one another, and supports emergency response. It is an intermediary as defined in section 2(1)(w) of the Information Technology Act, 2000.
GAMYO does not sell seats. GAMYO does not book rides. GAMYO does not operate transportation.
Specifically, GAMYO is not:
- a transport operator, taxi service, cab aggregator, carpooling marketplace, tour operator or travel agency;
- the owner, lessee or operator of any vehicle used on any journey;
- the employer, principal or agent of any Traveller;
- a party to any arrangement between Travellers, which is private between them;
- a seller of, or broker for, any seat, fare, ticket or transport service;
- a payment intermediary — GAMYO neither collects, holds, processes nor refunds money for travel;
- a guarantor of the identity, character, licence status, vehicle condition, driving competence or conduct of any User;
- an emergency service, a rescue service, or a substitute for one.
Because no fare is charged and no seat is sold through the Platform, a Connection formed on GAMYO is not a contract of carriage for hire or reward. Travellers must not use the Platform to operate a vehicle for hire or reward, or in any manner requiring a permit under the Motor Vehicles Act, 1988 or any state rule made under it. Attempting to charge a fare, sell a seat or run a commercial transport business through GAMYO is a material breach of these Terms.
6. Travel plans and connections
- A Traveller shares a Travel Plan: origin, destination, date, time and mode of travel. No price, fare or seat count is part of a Travel Plan, and the Platform provides no field in which to set one.
- Other Travellers may send a request to connect. The Traveller who shared the plan may accept or decline it. Nobody is added to any journey without that acceptance.
- Accepting a request forms a Connection and opens a chat thread. Meeting point, timing and all practical arrangements are agreed directly between the Travellers.
- Travelling together is voluntary at every moment. Either Traveller may withdraw before or during a journey.
- Any money that changes hands between Travellers — for fuel, tolls, food or anything else — is entirely a private matter between them, arranged outside the Platform. GAMYO neither sets, suggests, collects, holds, processes, refunds nor takes any share of it, and takes no responsibility for it.
- Search results, matches and suggestions are conveniences. They are not endorsements, verifications or recommendations of any Traveller, and we do not guarantee their accuracy or suitability.
7. If you are driving
If you drive on a journey arranged through GAMYO, you undertake that you will:
- hold a valid driving licence for the vehicle class and carry it on the journey;
- ensure the vehicle is roadworthy, registered, insured for the journey, and legally permitted to carry the number of people in it;
- give accurate vehicle and route details to the people travelling with you, and tell them promptly if anything changes;
- never drive under the influence of alcohol, drugs or any substance that impairs driving, and never while excessively fatigued;
- obey all traffic laws, speed limits and seat-belt and helmet requirements;
- not carry more people than the vehicle is licensed to seat;
- treat everyone travelling with you with respect, take no detour or route change without their agreement, and never leave anyone at an unsafe location;
- arrange your own insurance cover appropriate to carrying non-family occupants — GAMYO does not provide insurance of any kind.
8. If you are travelling with someone else
- Verify the vehicle against what the Traveller told you before you get in. If it does not match, do not board, and report it to us.
- Be at the agreed meeting point on time, and withdraw as early as possible if your plans change.
- Honour whatever private arrangement you made — GAMYO is not involved in it and cannot help recover it.
- Wear a seat belt or helmet as required, and follow reasonable instructions relating to the safety of the vehicle.
- Do not carry any prohibited, illegal, hazardous or restricted item, and do not smoke, consume alcohol or use drugs in the vehicle without consent and lawful permission.
- Treat the vehicle with care. You are responsible for damage you cause.
9. No fares, no payments
GAMYO is free to download and free to use, and no money changes hands on the Platform. There is no fare, no per-seat price, no booking fee and no commission — because GAMYO does not sell, broker or process travel.
If Travellers choose to share the cost of fuel, tolls or food between themselves, that is a private arrangement made outside GAMYO. We do not set it, suggest an amount, collect it, hold it, process it, refund it or take any share of it. We cannot recover it for you and we are not a party to any dispute about it.
Should GAMYO ever introduce a paid feature, the terms of that feature will be shown before you buy it and will not change the position above for travel between Travellers.
Repeatedly withdrawing at the last moment or failing to appear may result in reduced visibility, temporary restriction, or removal from the Platform.
10. Content you post
You own your Content. By posting it on GAMYO you grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, adapt (for format and display only), publish and distribute that Content solely for the purpose of operating, improving and promoting the Platform. This licence ends when you delete the Content, except for copies retained in backups for a limited period or where we are required by law to retain them, and except for Content that others have already shared or saved.
You confirm that you own or have the rights to everything you post, that it does not infringe anyone's intellectual property, privacy or publicity rights, and that any identifiable person in your Content has consented to appear.
We do not pre-screen Content. We may, but are not obliged to, review, restrict, remove or disable access to Content that we reasonably believe violates these Terms, the User Guidelines or applicable law.
11. Prohibited conduct
You must not, and must not allow anyone else to:
- post or transmit content that is obscene, paedophilic, defamatory, hateful, racially or ethnically objectionable, invasive of privacy, harmful to a child, or that incites violence or an offence;
- impersonate another person, misrepresent your identity or affiliation, or provide false vehicle or licence information;
- harass, stalk, threaten, intimidate or discriminate against any User, including on the basis of gender, caste, religion, region, disability or sexual orientation;
- use the Platform for commercial transport operations, unauthorised advertising, spam, multi-level marketing or the sale of any goods or services;
- use SOS, emergency alerts or emergency quick-dial numbers for anything other than a genuine emergency;
- track, follow or share the location of any person without their knowledge and consent;
- scrape, crawl, reverse-engineer, decompile, or attempt to gain unauthorised access to the Platform, its systems or another User's account;
- introduce malware, attempt to disrupt the service, or circumvent any security or rate limit;
- violate any law, or use the Platform to plan, facilitate or conceal an unlawful act.
12. Safety information, SOS and location
Read this before you rely on anything GAMYO tells you about the road. Safety Information is provided on a best-effort basis to help you make your own decisions. It is advisory, never a guarantee, and never a substitute for your own judgement, official sources, or the conditions actually in front of you.
What Safety Information can and cannot do
- GAMYO draws on third-party data, public sources and reports from other Users. Any of those may be wrong, incomplete, delayed or entirely absent.
- An absence of an alert does not mean a road is safe. A hazard may exist that GAMYO has not detected, cannot detect, or has not yet received data about.
- Conditions change faster than data does. A route shown as clear may have flooded, slipped or closed since the last update.
- Route suggestions, rest points, stays, fuel, hospitals and other places are suggestions, not verifications. We do not inspect, certify or vouch for any of them.
- Alerts depend on your device, its battery, its permissions and a working mobile network. Where any of those fail, GAMYO may tell you nothing at all.
- You remain fully responsible for how you travel — your speed, your route, your vehicle, your fitness to drive, and every decision you make on the road. GAMYO advises; you decide.
SOS and emergency features
GAMYO's SOS is not an emergency service. Holding the SOS button notifies the contacts you have saved, the nearby Travellers you have opted to include, and anyone already following your live location — and it helps you dial public emergency numbers faster. It does not dispatch police, ambulance or fire services, and it cannot work without a functioning device, adequate battery, location permission and a live mobile network. In a genuine emergency, call 112, 100, 108 or 101 directly.
- SOS activates on a deliberate 15-second hold, so that it does not fire by accident in a pocket. It will not activate any faster.
- An SOS alert reaches up to five registered emergency contacts, nearby Travellers where you have chosen to include them, and people you have already shared live tracking with. We cannot guarantee that any of them will see it, respond, or be able to help.
- Nearby Travellers who receive an alert are under no obligation of any kind to respond, and are not trained responders. Nothing in GAMYO creates a duty of rescue.
- Location accuracy depends on your device, GPS conditions and network coverage, and may be delayed or unavailable.
- Where a device becomes unavailable, GAMYO may display the last known location available to it. That position may be old and may not be where the person now is.
- Group alerts — including notification that a member has stopped or dropped off the network — are best-effort. A stop may be entirely innocent, and a real problem may produce no alert at all.
- You control who receives your location and for how long, and can revoke all location access at any time from the SOS screen.
- Emergency contacts are people you have chosen. Add them only with their knowledge, and make sure their numbers are correct.
- Profile details and reports are supplied by Users. We may perform checks, but we do not warrant that any of it is accurate or current.
- You remain responsible for your own safety. Use your judgement, tell someone where you are going, and do not travel with anyone you are not comfortable with.
13. Third-party services
Maps, directions, place information, weather, traffic, road-condition and hazard data are supplied by third-party providers — GAMYO's Safety Information is only as current and as accurate as they are. Calls, app-store distribution and push notifications involve third-party services governed by their own terms and privacy policies. We are not responsible for the accuracy, availability or conduct of any third-party service, and links to external sites are not endorsements.
14. Intellectual property
The GAMYO name, logo, app design, interface, source code, databases and all other material we provide are owned by or its licensors and are protected by Indian and international intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. You may not copy, modify, distribute, sell, lease or create derivative works from any part of it.
If you send us feedback or suggestions, we may use them without restriction or obligation to you.
15. Suspension and termination
We may restrict, suspend or terminate your access — with notice where reasonably practicable, and immediately where the situation involves safety, fraud, illegality or a legal requirement — if you breach these Terms or the User Guidelines, if your conduct puts other Users at risk, or if we are required to do so by law or a competent authority.
You may stop using GAMYO and delete your account at any time. Sections that by their nature should survive termination (including Content licence for already-shared Content, disclaimers, limitation of liability, indemnity and governing law) will survive.
16. Disclaimers
To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, timely, secure or error-free, that any defect will be corrected, or that any Ride, User, venue or piece of information will meet your expectations.
We expressly disclaim responsibility for the acts and omissions of Users, the condition or legality of any vehicle, the accuracy of any Content, and any dispute, loss, injury or damage arising out of a journey arranged through the Platform.
We further disclaim, to the maximum extent permitted by law, any warranty that Safety Information is accurate, complete, current or fit for any purpose; that a hazard will be detected; that an alert will be delivered, delivered in time, or delivered at all; that a suggested route, rest point or place is safe; or that an SOS alert will reach anyone or produce a response. Safety Information is an aid to your judgement, not a replacement for it.
17. Limitation of liability
To the maximum extent permitted by law, GAMYO, its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with your use of the Platform.
Where liability cannot be excluded, our total aggregate liability to you for all claims arising in any twelve-month period is limited to the greater of (a) the total amount of fees you actually paid to GAMYO in that period, or (b) ₹1,000.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our proven negligence, for fraud, or for anything else that cannot lawfully be limited.
18. Indemnity
You agree to indemnify and hold harmless GAMYO and its directors, officers and employees against any claim, demand, loss, liability, penalty or expense (including reasonable legal fees) arising from your Content, your use of the Platform, your breach of these Terms or applicable law, or your interaction with any other User.
19. Grievance redressal
In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of our Grievance Officer are:
We will acknowledge a complaint within 24 hours and resolve it within 15 days of receipt. Complaints about non-consensual intimate imagery or impersonation are actioned within 24 hours. To report a User, content or a safety incident quickly, use the in-app report option or write to .
20. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the paragraph below, the courts at , will have exclusive jurisdiction over any dispute.
Before commencing proceedings, both parties agree to attempt to resolve the dispute in good faith within 30 days of written notice. Consumers retain all rights available to them under the Consumer Protection Act, 2019, including the right to approach the appropriate consumer forum.
21. Changes and contact
We may update these Terms as the product and the law change. Material changes will be notified in the app or by email at least 7 days before they take effect. Continuing to use GAMYO after that date means you accept the updated Terms. The version published at gamyo.app is always the operative one.
